Toyata Recall: Lawyer Tells How He See Things

Hey, what is the the BIG deal, they were just trying to save a buck...well, $100 Millions bucks actually...reports of deaths connected to sudden acceleration in Toyota vehicles have surged in recent weeks, with the toll of deaths allegedly attributed to the problem reaching 34 since 2000.

Toyato and other auto manufacturers are ultimately legally responsible if their products are unsafe. Thousands of people continue to be harmed every year as a result of corporations making decisions based upon what goes in their pocket and not the ultimate safety of the citizens using their products. Well, money is the root of all evil, right?

In an internal presentation last year, Toyota officials claimed they saved over $100 million by delaying safety regulations, avoiding defect investigations and slowing down other industry requirements. Not to shabby, well, deplorable reall. The story is--Toyota saved $100 million by successfully negotiating with the government on a limited recall of floor mats in some Toyota and Lexus vehicles, according to new documents shared with congressional investigators.

The documents could set off alarms in Congress, and with Plaintiffs' lawyers, over whether Toyota put profits ahead of customer safety and pushed regulators to narrow the scope of recalls. The answer is most certainly: YES.

The world's largest automaker has been widely criticized for responding painfully too slow to complaints of sudden acceleration in its vehicles.

Toyota said in a statement, and you tell me if this is honest, or an honest attempt at spin: "Our first priority is the safety of our customers and to conclude otherwise on the basis of one internal presentation is wrong. Our values have always been to put the customer first and ensure the highest levels of safety and quality."Toyota_Logo_silver_svg.png

MO Rear-End Collision Leaves Illionois Man with Severe Injuries

According to the Missouri State Highway Patrol, William H. Pridemore, 51, of Quincy, Illinois was taken to the hospital after he was hit from behind by a 2007 Mack dump truck on the morning of December 28, 2009.

This commercial trucking accident transpired on Missouri Highway 6, about two miles east of Kirksville, when the 2003 Freightliner van, driven by Pridemore, was stopped and attempting to turn left when he was struck in the rear by the Mack truck, driven by Edwin E. West, 48, of Kirksville. The van then traveled off the right side of the roadway and came to a rest. Pridemore was then transported by ambulance to Northeast Regional Medical Center with serious personal injuries.

The dangers of 18-wheeler and large commercial trucks are prevalent in that drivers of smaller, commuter vehicles who are involved in accidents with these large trucks are likely to suffer serious personal injuries such as broken bones, brain and spinal cord damage, or even death. On the other hand, the drivers of these large trucks often walk away from these crashes unscathed.

Negligence on the part of large truck drivers is unacceptable and they, along with their employers, must be held accountable for their actions. Missouri 18-wheeler accident attorney, David Payne, will be glad to review your claim if you or a family member has suffered personal injuries or death due to the negligence of large truck drivers.

Contact David Payne anytime at 417.847.7516 for a free consultation and an outline of your legal rights and options.

Below are some statistics provided by the Missouri Department of Transportation.18_wheeler_250x251.jpg

• In 2007, there were a total of 72,155 crashes that involved passenger cars in Missouri.
• The percentage of these crashes that resulted in fatalities was about 0.06 percent.
• In 2007, there were a total of 5,052 crashes that involved 18-wheeler and large trucks.
• The percentage of these crashes that resulted in fatalities was about 2.0 percent.

As you can see from the statistics above, 18-wheeler and large truck accidents are nearly four times more likely to result in fatalities than accidents involving passenger cars. These accidents can often be life changing for the persons involved and their families.

Based on the Missouri State Highway Patrol’s accident report, it appears that the driver of the dump truck failed to slow down or didn’t see Pridemore as he was attempting to turn. If that was the case, both the truck driver and his employer could be held liable for the accident and the injuries that resulted from the crash.

This particular accident could have happened because the truck driver was careless and didn’t slow down. The 18-wheeler truck’s brakes could have failed. Or the truck driver could have been distracted. All of these are the most common causes of large truck accidents in the United States.

If you or a loved one has suffered personal injuries or death in an accident where an 18-wheeler or large truck was involved, you would be well-advised to contact experienced Missouri 18-wheeler accident attorney, David Payne, who will help determine who should be held responsible.

I-55 MO SUV Rollover Accident Leaves Two Girls With Serious Personal Injuries

An Interstate 55 SUV rollover accident in Pemiscot County leaves two Chesterfield girls, ages 8 and 12, with serious personal injuries, according to a crash report from the Missouri State Highway Patrol.

On the afternoon of Tuesday, December 29, 2009, Alexis D. Federer, 17, of Chesterfield, Missouri, was northbound at the one mile marker when her 2004 Cadillac Escalade ran off of the left side of the highway and overturned. Federer did not suffer any injuries, but two younger passengers were taken by air to Lebonheur Children’s Hospital in Memphis, TN with severe injuries.

Please keep these two girls in your thoughts and prayers as we wish them the best in a full and quick recovery.

According to the Missouri State Highway Patrol there were 102 fatalities in Missouri in the year 2007 due to the vehicle overturning. There were 2,081 rollover accidents that resulted in the occupants receiving personal injuries. Out of the 3,535 rollover accidents in Missouri, about 62% percent of those resulted in victims receiving personal or fatal injuries.

Based on the information from the highway patrol’s report, it appears that Federer lost control of her vehicle causing the SUV to veer off the roadway. There is no indication that she was speeding, fatigued, or under the influence of drugs or alcohol.

The question appears to be why did she lose control of her Cadillac Escalade? Was there a mechanical problem or a defective auto product that caused this rollover crash? Did a dangerous condition on the highway cause it? Was she run off the road by another vehicle?

In cases where negligence or wrongdoing is involved by another party, the families of injured and deceased auto accident victims would be able to file a claim that seeks compensation for things such as:

•Funeral costs
•Medical costs
•Loss of earnings
•Other cost relating to the accident

Families of victims in cases like these would be prudent to consult with an experienced Missouri SUV rollover lawyer at David Payne. David will analyze all aspects of the accident and pinpoint the cause. If it was a defective auto product that was responsible, the auto manufacturer could be held liable for the accident and the resulting injuries. If a dangerous road condition was the cause, then the government agency responsible for maintaining the roadway would be held liable.

I-55 Head-On Collision Results in Four Fatalities

Four people perished and three others suffered serious personal injuries as the result of an Interstate 55 fatality accident that occurred in the early hours of Sunday, December 27, 2009 in Pemiscot County near the southbound 8.4 mile marker, according to a report from the Missouri State Highway Patrol.

If you or a loved one has suffered personal injuries or death due to the negligence of another party out on our Missouri roadways, you would be well-advised to consult with Missouri auto accident attorney at David Payne Law. David will examine all aspects of your case to outline the best path of legal action.

This I-55 head-on collision took place as a northbound Cadillac Escalade, driven by Leon Cash, 57, of Rockford, Illinois, crossed the median and struck a southbound GMC Yukon, driven by Howard M. Gilliland, 60, of Memphis, Tennessee. Both Cash and Gilliland suffered fatal injuries as a result.

Vontina A. Gilliland, 27, and Felecia R. Reeves-Gilliland, 52, also of Memphis, TN were pronounced dead at the scene by Pemiscot County Coroner Jim Brimhall. Maxine Cash, 56, of Rockford, IL, was the other passenger in the Escalade and was taken by air to the Elvis Presley Trauma. Two other male passengers in the Yukon, ages 5 and 7, were taken to Lebonheur Children’s Hospital in Memphis.

My heart goes out to the families of Leon Cash, Howard Gilliland, Vontina Gilliland, Felecia Reeves-Gilliland and Leon Cash who were tragically killed in this Missouri auto accident. I offer condolences to their loved ones. Please keep them in your prayers.

Also, please keep Maxine Cash and the two young boys in your thoughts and prayers as we wish them the best in a quick and complete recovery.

While on the road, drivers are required under law to exercise "reasonable care under the circumstances." If a driver fails to use reasonable care, then there is negligence involved. Whether they are speeding, drunk, distracted, or very fatigued, negligent drivers put themselves and others at risk out on the road.

In cases where the driver does not exercise reasonable care, the injured parties would be eligible to receive compensation that can cover the following:

• Medical expenses
• Loss of wages
• Cost of physical therapy
• Other damages relating to the accident

In almost all cases, there is an insurance company that is responsible for all, if not a portion, of the injuries resulting from their insured driver's negligence. If the at-fault driver lacks car insurance or sufficient insurance coverage, then the family of the deceased or injured victims might be able to acquire benefits from the uninsured or under-insured motorist clause in the victim’s car insurance policy.

Experienced auto accident attorney David Payne will guide victims and their families through this legal process.

MoDOT Responsible for Fatality in Tractor-Trailer Accident

Jemma Dant, 28, of St. Louis, died in December 2005 when an 18-wheeler truck hit her vehicle and forced it into another truck on I-44 near St. Louis, MO.

If you or a loved one has been injured or killed due to the negligence of another on Missouri’s roadways, contact auto accident attorney David Payne. He has the experience you need to help you through all the aspects of your accident and take one more step in keeping our roadways safe.

A panel has just recently ruled that the Missouri Department of Transportation (MoDOT) must claim responsibility. The panel was ordered to pay $1.3 million to the family of Jemma Dant because of the fact that they failed to give enough warning of the halted traffic on the Interstate.

The attorney representing Dant’s family stated, “The whole argument is that if you (MoDOT) just would have warned the motorists of the traffic backup, the crash wouldn’t have occurred. If there’s going to be something unexpected on a highway, you have to warn people about that.”

Auto accident victims who are injured by a negligent driver can receive compensation that covers the following:
• Medical expenses
• Loss of wages
• Cost of physical therapy
• Other damages relating to the accident

A skilled auto accident attorney at David Payne Law will also look into whether a dangerous road condition could have contributed to the accident, like in the case of Jemma Dant. Tire Tread Separation Leads To A Blowout and Serious Injury On I-55

A Missouri defective tire/SUV rollover crash leaves two victims with serious personal injuries.

A 1999 Chevrolet Tahoe, driven by Rodney D. Todd, 38, of Coldwater, Mississippi, had a tire blow-out on Interstate 55 about three miles north of Steele, MO. The Tahoe ran off of the right side of the highway and overturned. Todd was taken to Pemiscot Memorial Hospital with serious injuries. The occupant, Timothy A. Webster, 18, of Washington, Indiana, was air-lifted to Elvis Presley Trauma Center in Memphis, Tennessee with severe personal injuries.

It is very fortunate that there weren’t any fatalities in this Missouri defective tire accident. I wish both the victims the very best for a quick and complete recovery.

A tire blow-out is one of the scariest things that can happen to a driver on the roadway. Tire tread separation at highway speeds can often cause the vehicle to overturn, like the Tahoe in this case. Rollover accidents are known for causing tragic injuries or even death.

This is a classic case of a defective tire and tire tread separation, which caused the Ford Explorer to travel off of the road and overturn. Dealing with defective tire cases, we are beginning to see more cases of tire failure due to a manufacturing or design defect long before the tread on the tire has deteriorated.

If a defective tire is proved to be the result of a manufacturing or design defect, then the injured parties would have a claim against the tire manufacturer for injury and damage compensation that include:

•Medical expenses
•Loss of wages
•Cost of physical therapy
•Funeral costs
•Mental stress and trauma
•Other damages relating to the accident

If you live in Missouri and you or someone you care about has been the victim of an auto accident caused by a defective tire, please contact David Payne Law to schedule a free and confidential consultation with an experienced defective tire attorney.

Highway 65 SUV Rollover/Tire Blow-Out Accident Results In Fatal Injuries - Wrongful Death Claim

The Missouri State Highway Patrol (MSHP) has identified a Missouri man who died in a US-65 rollover accident as Stephen P. Bullock. According to a report from the MSHP, Bullock, 35, of Brighton, was traveling southbound on US Highway 65, about two miles north of Springfield, when his 2001 Ford Explorer suffered a tire blow-out. Bullock lost control, ran off of the roadway, and overturned several times. He was pronounced dead at the scene by Assistant Greene County Medical Examiner David Brown.

My heart goes out to the family of Stephen Bullock who was tragically killed in this Greene County rollover accident. I offer my deepest condolences to his loved ones. Please keep them in your prayers.

Tire failure, or tire tread separation, are among the most common auto product defects that can cause drivers to lose control of their vehicles. During a blow-out, it is very common for the driver to lose control of the vehicle and it is tough, even for skilled drivers, to correct the situation.

According to the National Highway Traffic Safety Administration (NHTSA), about 10,000 people die every year in rollover accidents across the U.S.

Get in touch with a reputable Missouri defective tire accident attorney at David Payne Law, LLC, who will be able to help determine whether the defective tire was the cause of the accident. The vehicle and the tire must be preserved in their current conditions so they can be looked over for evidence of defects and/or malfunctions.

If you live in Missouri and you or someone you care about has been the victim of an auto accident caused by a defective tire, please contact David Payne Law to schedule a free and confidential consultation with an experienced defective tire attorney.

Ozarks Woman Is Seriously Injured In An Branson Rollover Crash

Wendi D Piemonte, 33, of Branson West, MO suffered serious personal injuries in a Missouri SUV rollover accident, according to a report from the Missouri State Highway Patrol.

On the afternoon of July 14, 2009, was westbound on Rolling Acres Road south of Branson West when her 2005 GMC SUV ran off of the roadway and overturned. Piemonte was then taken to Skaggs Regional Medical Center.

I wish Wendi the best towards a quick and complete recovery.

Thousands of Americans die every year in rollover accidents. According to the National Highway and Traffic Safety Administration (NHTSA), at least one quarter of traffic accident fatalities occur in rollover crashes. Auto manufacturers are continuing to make vehicles with weak roofs that can easily cave in and crush the passengers inside. This can result in disastrous injuries to the brain and spinal cord or even death.

In this Missouri rollover accident, it's not clear what caused Piemonte to run off the roadway. An experienced rollover accident attorney, David Payne, would look into whether there was a mechanical problem or motor vehicle defect involving the GMC that may have caused this Missouri rollover accident.

If this car accident was caused by some type of defective product, then the car maker could be held liable for the personal injuries that it caused. This compensation would include the following:

•Medical expenses
•Funeral expenses
•Cost of medication
•Hospitalization and long-term care
•Loss of wages
•Other damages resulting from the accident

If you suspect your personal injuries are a result of a defective car or a car product defect, please contact experienced Missouri rollover accident attorney David Payne at 417.847.7516 to find out more information about your legal rights and options. Two Missouri Men Were Seriously Injured In MO-32 Semi Truck Collision

Two gentelmen suffered serious personal injuries in a Missouri 18-wheeler accident on July 14, according to a report from the Missouri State Highway Patrol.

Mark L. Mickel, 43, of Matthews, MO, was traveling westbound on Highway 32 in a 1996 International truck when he crossed the center line and hit a 2005 Chevrolet Uplander, driven by Stephen K. Nixon, 62, of St. Louis, MO. Mickel went off the left side of the road and hit a tree. Nixon went off the right side and overturned. Both men were taken to St. Genevieve County Hospital with minor personal injuries.

So many of these accidents result in serious injuries and death, but luckily this Missouri commercial truck accident resulted in only minor injuries for the persons involved. 18-wheeler.jpg

I wish the best for these two gentlemen in their recoveries.

Although there were less large truck-related accident deaths in 2008 (4,229) compared to 2007 (4,822), too many Americans continue to perish in 18-wheeler and large trucking accidents. Although some of these accidents do not occur at the fault of the truck driver or trucking company, there are still steps that they can take to prevent accidents.

Steps that truck drivers can take include, but are not limited to, the following:

•Do not drive when fatigued
•Always check your blind spots
•Stay a safe distance behind other vehicles
•Properly maintenance your truck
•Reduce your speed in work zones
•Frequently inspect your truck
•Properly secure your cargo
•Practice defensive driving
•Always get plenty of rest before driving

If you or a loved one has been injured or killed in a Missouri 18-wheeler and large truck accident, please contact an experienced Missouri injury attorney at David Payne Law. David will properly investigate the evidence, assess your injuries, and pursue the maximum recovery that you deserve.

Update On Interstate 44/OK 18-Wheeler Accident - Wrongful Death

The June 28 seven-vehicle pile-up that took place on the Will Rogers Turnpike left 10 people wrongfully dead and marked Oklahoma’s 32nd fatal 18-wheeler accident, according to a recent OKNews article.

Seven federal investigators from the National Transportation Safety Board, along with local investigators, looked through the remains of one of Oklahoma’s deadliest highway crashes. Capt. Craig Medcalf of the Oklahoma Highway Patrol (OHP) determined that the tractor trailer was roadworthy and its brake pads were in good condition.

"In an accident of this magnitude, everything’s going to be closely looked at,” Medcalf said.

The truck’s driver, Donald Creed, 76, of Willard, MO, could face up to 10 negligent homicide charges, Ottawa County District Attorney Eddie Wyant said.

The 18-wheeler is owned by Associated Wholesale Grocers (AWG) of Kansas City, KS. According to the Federal Motor Carrier Safety Administration (FMCSA), AWG has a satisfactory rating. The FMSCA’s records show no problems with the company’s drivers and they have an above-average-out-of-service-rate, which is how frequently the trucks have been taken off of the road after a safety threat is found.

On the afternoon of the crash, Larry Smith, of Tulsa, OK, was stuck in traffic on I-44, along with his wife, granddaughter, and one of her friends, on their way to Branson to celebrate his granddaughter’s birthday.

Smith’s wife, Marcella, heard the crash. “All of a sudden we heard this pow-pow-pow there. There was no horn. No screeching. No anything,” said Marcella.

The OHP determined that Creed was in “apparently normal” condition with no sign of drug s or alcohol and he was not using a cell phone.

A cruise-control device revealed that Creed’s truck was traveling at 71 mph at the time of the crash, Horton said. The speed limit on that stretch of the turnpike is 75 mph.

"We actually interviewed truck drivers that were immediately behind him, they all were able to detect the backup so they started backing off and slowing down,” said Patrol Captain Scott Horton. "He just pulled away.” Troopers saw no signs or evidence of braking by Creed, continued Horton. "No skid marks,” he said. "We didn’t see any visible signs of braking.”

“While Creed was within federal daily driving limit requirements, fatigue could have played a factor in the crash,” Horton said. “It will be at least a month before a report will be ready to turn over to prosecutors,” he added

Clayton Boyce, vice president of public affairs for the American Trucking Association, offered condolences to the victims’ families. Little can be said until after the investigation is complete, he stated.

Families in which loved ones have perished or suffered personal injuries due to an 18-wheeler accident, like this one, would be well-advised to retain the services of experienced Missouri 18-wheeler accident attorney, David Payne. David Payne Law will help determine the facts of the case, identify the negligent parties, and attempt to hold them responsible.

Where negligence or wrongdoing is involved, families of deceased traffic accident victims are able to file a wrongful death claim. Such a claim compensates the victim’s families for the death of their loved one that may have been caused by the negligence of another party.

Kiyle J. Chiou, 18, of Carl Junction, MO suffered personal injuries in a Missouri pedestrian accident after he was struck by a hit-and-run driver on July 19. Victims and their families, who have been injured or killed due to the negligence of another party, would be advised to contact an experienced Missouri personal injury lawyer at David Payne Law.

According to a report from the Missouri State Highway Patrol, Chiou was walking southbound in the northbound lane of Route JJ, which is about four miles north of Joplin. According to Chiou, an unknown vehicle, traveling northbound, struck him and left the scene. Chiou was then transported to Freeman West Hospital in Joplin with minor injuries.

Please keep Mr. Chiou in your thoughts and prayers as we wish him the best in a full and quick recovery.

Hit-and-run or fleeing the scene of an accident is a serious offense in the state of Missouri. The law clearly states that any driver involved in a traffic accident in Missouri must stop at the scene of that accident. Drivers are required to show proper identification and give contact and car insurance information to the all parties involved. Leaving the scene because of panic or stress is not a valid excuse.

Missouri Revised Statute 577.060 states: Leaving the scene of a motor vehicle accident is a class A misdemeanor, except that it shall be a class D felony if the accident resulted in:

•Physical injury to another party
•Property damage in excess of $1,000
•If the defendant has previously pled guilty to or been found guilty of a violation of this section.

A Highway 96 Crash Near I-44 Leaves An Ozarks Woman Dead After Her Ford Explorer Overturned

A MO-96 SUV rollover accident in Lawrence County leaves a Carthage woman with fatal injuries, according to a crash report from the Missouri State Highway Patrol.

On the morning of Wednesday, July 22, Leslie D. Laney, 48, was westbound on Missouri Highway 96 about five miles west of Halltown when her 1999 Ford Explorer ran off of the left side of the road. She overcorrected, ran off the right side of the highway and overturned. Laney was pronounced dead at the scene be Deputy Coroner Scott Lakin.

My deepest sympathies are extended to the loved ones of Leslie Laney. Please keep them in your thoughts and prayers.

This makes the 57th fatality for Troop D in 2009.

Based on the information from the highway patrol’s report, it appears that Laney lost control of her vehicle causing the SUV to veer off the roadway. There is no indication that she was speeding, fatigued, or under the influence of drugs or alcohol.

The question appears to be why did she lose control of her Ford Explorer? Was there a mechanical problem or a defective auto product that caused this rollover crash? Did a dangerous condition on the highway cause it? Was she run off the road by another vehicle?

In cases where negligence or wrongdoing is involved, then the families of deceased auto accident victims would be able to file a wrongful death claim that seeks compensation for things such as:

•Funeral costs
•Medical costs
•Loss of earnings
•Other cost relating to the accident

Families of victims in cases like these would be prudent to consult with experienced Missouri SUV rollover lawyer David Payne.

Ozarks Man Suffers Injuries Due To A Defective Tire/SUV Rollover Accident

A Springfield, Missouri man suffered serious personal injuries in a defective tire accident that occurred on Missouri Highway 13, according to a report by the Missouri State Highway Patrol.

On July1, 2009, Malcolm, R. Murray, 32, of Springfield, MO lost control of his 2001 Ford Edge after a tire blew out about ten miles north of Springfield about 1:45 in the afternoon. Malcolm then skidded off the right side of the road and overturned several times. Malcolm was then transported to St. Johns Hospital by ambulance.

The results of tire tread separation can be disastrous. They frequently cause tire blowouts, like in this example with Malcolm and his Ford Edge, and they will cause the driver of the vehicle to lose control. When the tread of the tire and the belt separate from the inside of the tire, it results in serious crashes and even rollovers. These accidents frequently cause serious injuries and death to the occupants of the vehicle.

Victims, like Malcolm, and their families would be well-advised to retain the services of Missouri auto product liability lawyer David Payne. David would look into whether the tire was poorly designed or defective tire was the cause of the accident. The Ford’s tire manufacturer could be held liable for compensation if the tire is found to be defective or poorly designed.

If you or a loved one believes that a defective tire might have been responsible for your motor vehicle accident, please contact the law office of Missouri defective tire attorney David Payne.

Contact David Payne anytime online or at 417.847.7516 for a free consultation.David will give you the legal assistance that you need to figure out your options for compensation.

Clarence, MO Woman Endures Injuries in Semi-Truck Crash

A Missouri 18-wheeler accident leaves a Clarence girl with serious personal injuries.

Kelli A. Chittum was taken to Samaritan Hospital on the afternoon of June 30, 2009 after a 2005 Freightliner, driven by Bronius Steponavicius, 52, of Schiller Park, IL, rear-ended the 1994 Volvo she was in. Chittum was stopped in a construction zone, along with Howard W. McConnell, 89, of Leonard, MO, when Steponavicius hit her. This caused Chittum to then hit the rear of McConnell’s 2001 Mercury.

In this commerical trucking case, it is not clear why the negligent driver did not stop; it could have been a number of reasons:

•Bad weather
•Sleep Deprivation by the truck driver
•Use of drugs or alcohol by the driver
•Improper upkeep of the truck
•Malfunction of the truck’s brakes
•Improper loading

Jeep Cherokee Rollover Crash Leaves Woman Seriously Injured

A Bourbon woman suffered injuries in a Missouri SUV rollover accident on July 1, 2009, according to a report from the Missouri State Highway Patrol (MSHP).

Families of victims who have experienced tragic injuries or even death should contact a product liability lawyer at David Payne Law, LLC.

Brenda S. Hamilton, 59, was driving on Route P about two miles north of Cuba, MO when her 1998 Jeep Cherokee traveled off of the right side of the roadway. When Hamilton returned to the roadway, her Jeep overturned several times and traveled off of the left side of the road before finally coming to a rest. Hamilton was taken by a Crawford County ambulance to the Cuba airport where she was then flown to St. Johns in Creve Coeur.

Every year, more than 40,000 people perish in rollover accidents in the United States. More than half of these rollover accident fatalities involve SUVs. The main reason is because SUVs lack roof strength and as a result the occupants of the vehicle are at a high risk for severe brain and spinal cord injuries.

In this particular case, based on the MSHP’s report, it is not clear why Hamilton lost control of her Jeep. There could have been numerous reasons to why this accident could have happened like driver error, a mechanical problem, a dangerous roadway, or a defective auto product. If the accident did happen because of a defective auto product, then the manufacturer of the vehicle could be held liable for compensation.

Injured victims and their families can acquire compensation to cover the following:

•Medical expenses
•Funeral expenses
•Medication costs
•Hospitalization costs
•Loss of wages
•Other damages resulting from the accident

If you suspect your personal injuries are a result of a defective car or a car product defect, please contact experienced Missouri rollover accident attorney David Payne at 417.847.7516 to find out more information about your legal rights and options. Claracp E. Walsh, 59, of Festus, MO, was struck by a truck while she was on her bicycle about 6:25 in the evening. The 2007 GMC Sierra, driven by Melinda M. Lewis, 37, of Hillsboro, MO, was merging onto Route A from Sandy Valley Dr. just northeast of Hillsboro. Lewis failed to notice Walsh on her bicycle and stuck her. Walsh was then taken to St. Johns Medical Center with serious personal injuries.

Please keep Claracp in your thoughts and prayers as she recovers from her injuries.

The following statistics are from the Missouri State Highway Patrol for the year 2007:

• One person was killed or injured in a bicycle traffic crash every 15.7 hours in the state of Missouri.
• About 82% of all bicycle-involved traffic crashes resulted with personal injuries.
• About 1% of all bicycle-involved traffic crashes resulted in a fatality.

Under Missouri law, bicyclists are subject to the same traffic laws as motorists. Due to this, bicycle riders deserve the same protection by these laws. Regardless of where you are in Missouri, victims of bicycle accidents involving vehicles deserve compensation to recover from things such as:

Serious Personal Injury ~ SUV Rollover Accident Results From Jeep Liberty

An Orrick, MO man is recovering from personal injuries from a Missouri SUV rollover accident on June 28, 2009, according to a recent Missouri State Highway Patrol report.

Joesph A. Waters, 49, failed to negotiate a curve and lost control of his 2003 Jeep Liberty. He traveled off the right side of the roadway, struck an embankment, and overturned. The Jeep then struck a fence and came to a rest on all four tires. An investigation is continuing. Waters was then taken by ambulance to the Ray County Hospital with personal injuries.

The following information is provided by the National Highway Traffic Safety Administration (NHTSA) and consumer rights group, Public Citizen:

• There were a total of 10,698 rollover accidents that resulted in fatalities in the United States in 2006, according to the NHTSA.

• This accounts for about 35% of vehicle occupants killed in traffic accidents, according to Public Citizen.

• Ten years before that, in 1996, there were 9,379 rollover accidents that resulted in deaths, according to the NHTSA.

• This only accounted for 29% of vehicle occupants killed in traffic accidents, according to Public Citizen.

The 2003 Jeep Liberty Rollover Resistance Rating was a two, out of five, stars! That is not good.

The Rollover Resistance Rating is an estimate of the vehicle’s chances of rolling over in a single-vehicle crash. The rating looks at a vehicle’s characteristics, such as its center of gravity and track width, to determine how “top heavy” a vehicle is. The more “top-heavy” a vehicle is, the more likely it is to roll over.

Since the 2003 Jeep Liberty got a rating of two stars that means it is three times more likely to roll over than vehicles with the highest rating of five stars.

If this Missouri SUV rollover accident was caused by some type of defect on the vehicle, then the car maker could be held liable for personal injuries or death that resulted from the accident. In similar cases, families of deceased rollover accident victims may be eligible to file a wrongful death claim, which compensates families for funeral expenses, loss wages, and other related damages.

If you or a loved one has experienced personal injuries or death as a result of a defective car or a car product defect, please contact experienced Missouri rollover accident attorney David Payne.

Missouri Resident Killed In Early Morning Crash ~ Negligent Driver Fell Asleep

A Missouri man was killed in auto accident in the early hours of June 28, 2009 in Montgomery County, Texas, according to a report from the Houston Police Department (HPD).

The accident occurred on U.S. Highway 59, near Kingwood Drive, as Willie T. Tolbert, 54, and his wife was pulled over on the shoulder of the roadway to switch drivers. When Tolbert exited the driver side of the Chevrolet Aveo, a Dodge Ram pickup veered onto the shoulder and struck him and his vehicle.

The HPD indicated that there was not alcohol involved. However, they did indicate that the driver of the Dodge had fallen asleep at the wheel when he hit Tolbert. The pickup rolled over and the driver was ejected. Tolbert was pronounced dead at the scene and his wife did not sustain any physical injuries.

While on the road, drivers are required under law to exercise "reasonable care under the circumstances." If a driver fails to use reasonable care, then there is negligence involved. In cases, like the one above, where the driver does not exercise reasonable care, the injured parties would be eligible to receive compensation that can cover the following:

• Medical expenses
• Loss of wages
• Cost of physical therapy
• Other damages relating to the accident

Injuries Follow 18-Wheeler Wreck On Missouri Highway 71

According to the Missouri State Highway Patrol, two residents of Lamar, MO were taken to the hospital after they were hit from behind by an 18-wheeler truck on the afternoon of June 15, 2009. This Missouri 18-wheeler accident transpired on Highway 71, three miles south of Lamar, when a 2005 Buick, driven by John Wagaman, 78, was attempting to change lanes and was struck in the rear by a 2006 Freightliner, driven by Eric M. Fields, 37, of Billings, MO. The Buick ran off of the highway and came to rest in a ditch. Wagaman and his passenger, Nora Wagaman, 77, were taken to Barton County Memorial Hospital after sustaining personal injuries.

Below are some statistics provided by the Missouri Department of Transportation:

16317459.jpg

Based on the Missouri State Highway Patrol’s accident report, it appears that the driver of the semi truck failed to slow down or didn’t see Wagaman as he was changing lanes. If that was the case, both the truck driver and his or her employer could be held liable for the accident and the injuries that resulted from the crash.

Tractor Trailer Accidents ~ 18-Wheeler Trucks ~ Safety For All On Missouri Public Roads ~ Lawyer

18-wheeler trucks are far more dangerous on our Missouri highways than smaller cars, trucks, or SUVs. These large trucks require more time to stop, they have larger blind spots, and they carry larger, heavier cargo. 18-wheeler trucks are also more susceptible to turning over due to their high center of gravity.

Some statistics for the state of Missouri provided by the Federal Motor Carrier Safety Administration include:

• In 2007, 1,557 large trucks were involved in crashes in which passengers sustained personal injuries.
• In 2007, there were 2,332 injuries in crashes involving large trucks.
• Also, there were 136 fatalities in crashes involving large trucks in 2007.

If you or a loved one has suffered personal injuries or death in an accident where an 18-wheeler or large truck was involved, you would be well-advised to contact experienced Missouri 18-wheeler accident attorney, David Payne, who will help determine who should be held responsible.

Some causes of 18-wheeler and large truck accidents are listed below:
• Driver error
• Driver negligence
• Lack of proper maintenance of the truck
• Overloading the truck
• Driving at unsafe speeds

In Missouri accidents involving 18-wheeler or large trucks, it is the driver or the passengers of the smaller, commuter vehicles who suffer the most. 18-wheelers can weigh up to 40 tons and the impact of a truck that size crashing into a smaller vehicle can be enormous. Even when survivors emerge from the crash, injuries resulting from such accidents can be cataclysmic.

Missouri 18-wheeler accident attorney, David Payne, will be glad to review your claim if you or a family member has suffered personal injuries or death due to the negligence of large truck drivers.

Tire Blow-Out Results in Ford Explorer Accident ~ Serious Personal Injury ~ Tread Separation Defect ~ Interstate 44 Missouri

I-44 SUV rollover accident results in serious personal injuries due to a tire tread separation defect. All four occupants of the vehicle were taken to the hospital with serious injuries after the 2004 Ford Explorer, driven by Penny K. Grechus of Farmington, MO, blew a rear right tire and veered off the left side of the highway and overturned several times before coming to rest.

One of the passengers, Cassidy L. Cooper of Appleton City, MO, was ejected from the vehicle and taken to Phelps County Regional Medical Center along with Amanda K. Smith of Springfield, MO, and Julie M. Smith of Montrose, MO. Grechus was flown to Barnes Jewish Hospital.

It is fortunate that nobody suffered fatal personal injuries in this Missouri defective tire accident. I wish the four injured victims the very best for a quick and complete recovery.

A tire blow-out is one of the most alarming things that can happen to a driver on our Missouri roadways. Tire tread separation at highway speeds can often cause the vehicle to rollover like Explorer in this case. Rollover accidents normally cause devastating injuries or even deaths.

This is a classic case of tire failure and tire tread separation, which caused the Ford Explorer to travel off the roadway and overturn. Dealing with defective tire cases, we are beginning to see more cases of tire failure due to a manufacturing or design defect long before the tread on the tire has deteriorated. If a defective tire is proved to be the result of a manufacturing or design defect, then the injured parties would have a claim against the tire manufacturer for injury and damage compensation.

If you live in Missouri and you or someone you care about has been the victim of an auto accident caused by a defective tire, please contact David Payne Law to schedule a free and confidential consultation with an experienced defective tire attorney.

Contact David Payne at 417.847.7516 to discuss your legal rights and the options you have regarding your claim.

SUV Rollover Accident ~ I-44 in Lawrence County, Missouri ~ Serious Personal Injury ~ Wrongful Death

Anna Leal and Jaime Rodriguez of Fort Worth, Texas, were killed in a Missouri rollover accident on the morning of June 4, 2006, the Springfield News-Leader reports. The Missouri Highway Patrol reported that Leal and Rodriquez were pronounced dead at scene on Interstate 44 near Stotts City. The accident occurred when the eastbound 2001 Ford Explorer, driven by Luis E. Nunez, ran off the roadway and into the median before rolling several times.

I offer my deepest condolences to the family and friends of Anna Leal and Jaime Rodriguez for their tragic and heartbreaking loss. Please keep them in your prayers.

According to the National Highway Safety Traffic Administration (NHTSA), there are on an average about 40,000 traffic accident fatalities each year in the United States. The federal agency estimates that about 25 percent of these accidents are rollover accidents. car_accident_lawyers.jpg
With rollover accidents, the chance of fatal injuries is much higher because of the intensity of the crash.

In this I-44 Missouri rollover accident, it's not clear why the driver lost control of the vehicle. An experienced rollover accident attorney, David Payne, would look into whether there was a mechanical problem or motor vehicle defect involving the Ford Explorer that may have caused this fatal Missouri rollover accident.

If this car accident was caused by some type of defective product, then the car maker could be held liable for the fatal personal injuries. In product liability cases, families of deceased car accident victims may be able to file a wrongful death claim. Such claims compensate these families for funeral expenses, loss of wages and other related damages.

If you suspect your personal injuries are a result of a defective car or a car product defect, please contact experienced Missouri rollover accident attorney David Payne at 417.847.7516 to find out more information about your legal rights and options. Three people were injured in a two-vehicle accident on Missouri Highway 171 at Carterville in Jasper County. The driver of one of the vehicles, Tammi S. Byrd, of Duenweg, and two of her passengers, Lexi S. Byrd and Caroline S. Lundstrum sought medical treatment for injuries on their own, the patrol said. Byrd’s vehicle ran into the rear of a southbound truck rig driven by Octavio Rodriguez, of Carl Junction, as Rodriguez slowed for another accident in the area, according to reports.

Five people were injured in a two-vehicle accident on U.S. Highway 71, five miles north of Nevada in Vernon County. Both drivers, Raymond W. Weaver, 44, of Pittsburg, Kan., and Robert W. Brooks, 29, of Nevada, were taken to Nevada Regional Medical Center, the patrol said. A passenger in Weaver’s car, Kenneth K. Phillips, 19, of Pittsburg, and two passengers in Brooks’ car, Michelle D. Brooks, 33, and Kipton W. Brooks, 7, both of Nevada, were taken to the same hospital, the patrol said. Weaver was southbound on the icy highway when he lost control of his car, and it ran off the road, across the median and struck Brooks’ northbound car head-on, the patrol said.

Documentation! Documentation! Documentation! The insurance claim business is one of properly and fully documenting your financial loss. To insurance companies, it doesn't matter about your injuries if you fail to properly document. Your claim will be denied or your recovery will be incomplete. I have experience in handling people's claims in order to insure that the insurance companies are provided with proper documentations regarding my client's financial losses.

Often times, there will be several different insurance policies which apply. Uninsured insurance coverage, underinsured insurance coverage, medical payments coverage and umbrella policies exist and can be found and revealed by an experienced automobile insurance claims attorney. Of course, if the insurance companies fail to offer a satisfactorily settlement, I will file a lawsuit aimed at holding the insurance company fully accountable for your losses.

MADD Hold Candlelight Vigil In Memory Of Accident Victims

As an injury attorney, the most heart-wrenching stories I come accross involve tragedies that are completely avoidable. Tragedies that were caused by the selfish, mindless acts of others don't simply bohter me, they appaul and outrage me.

However, out of these preventable tragedies often comes great compassion. When a community sets out to right a wrong, when a community supports the victims, when a community endeavours to stop the senselessness of drunk driving--a greater good can be accomplished.

My thoughts and prayers go out to the family and the community discussed in the St. Louis Post-Dispatch story which I have listed below. God Bless.

ST. LOUIS POST-DISPATCH
12/07/2008

Kirkwood — Six-year-old Luke Schaff doesn't remember much about his uncle.

It's been more than two years since Zachary Huggins, 22, of Harvester, was killed in a drunk driving accident, and his nephew, Luke, was only 4 at the time. Huggins was a passenger in a car driven by a drunken driver who swerved off the road and struck a utility pole.

That's why Pam Huggins, Luke's grandmother and Zachary's mother, said she liked her grandchildren to attend events such as the candlelight vigil Saturday sponsored by Mothers Against Drunk Driving Gateway Affiliate. Zachary is absent from their lives on a daily basis, but she doesn't want the children to forget about their uncle.

"That's the one way we try to get them to remember," she said.
Dozens of families of people killed in drunk driving accidents gathered at the Kirkwood United Methodist Church on Saturday to honor the memories of their lost loved ones and bring attention to the dangers of driving under the influence.

For Pam Huggins, her message is simple.

"It's so preventable. It's so needless," she said. "Our children were stolen from us and they didn't have to be."

Brian Buchholz, of St. Louis, said he started attending MADD meetings after his stepdaughter, Nicole Allen, 21, died in a drunk driving accident last year.

Allen, a junior at the University of Missouri-St. Louis, was a passenger in a car that was stopped at a red light when another car plowed into it, killing Allen and injuring two others. The driver of the other car had a blood-alcohol level of 0.24 percent when the crash occurred, police reported at the time — three times the legal limit.

Buchholz said that the experience had been extremely trying for his family, but that coming to events such as the candlelight vigil helped.

"You need a place to go to be sad," he said. "You need to be around people who have been through what you've been through."

Now, Buchholz said, he is honing his public speaking skills in hopes of eventually giving presentations to groups of people. He wants to tell his family's story because, he said, it's one that is repeated far too often.

"This was always something that happened to other people," he said.

Time Is Of The Essence

If you are involved in an accident with a big truck contact DAVID PAYNE LAW an experienced truck accident lawyer immediately to protect your rights!

This is crucial because:

The truck company and their insurance company will send representatives to the accident scene immediately; the truck company will call investigators to the crash scene (often before the police finish investigating); and the truck company may begin destroying records (I encounter this on a regular basis in truck accident cases).

If DAVID PAYNE LAW is contacted soon after the truck crash, we can take legal steps to prevent record destruction.

What is the difference between truck accident lawyers and lawyers in general?

How do I find a law firm with experienced truck accident attorneys?

Why was the truck driver taking photos of the truck accident scene?

As an experienced tractor trailer accident lawyer, I will discuss your case with you and answer any questions you may have.

Advice From An Experienced Injury Lawyer In Southwest Missouri ~ David Payne Law

In Missouri, virtually all car accident and personal injury cases are handled by lawyers working on a contingency basis. Contingency contracts mean that the attorney will only recover if the client recovers financial settlement or Judgment.

In most cases, the lawyer will front any cost associated with the case and only get reimbursement from the client once settlement is obtained. Most contacts don't put the client in a position risk of having to pay anything should the attorney not be successful.

At the very beginning of the attorney/client relationship, the lawyer's fee will be determined with a signed, written agreement between the client and the lawyer.

"David Payne will take care of your injury case--Experienced Personal Injury Lawyer"

Such agreements generally state that the client will owe NO FEE if the lawyer fails to obtain any money for the client. Only if money is collected does a fee for the lawyer kick in. You can expect the lawyer's fee to be between 25-40% of what is collected. I would suggest that a lawyer fee of 33% is the most common.16317459.jpg

Don't forget to discuss who will be responsible for the costs the attorney incurs in your case. The agreement can state that the client won't be responsible for costs is no fee is recovered, too. However, some lawyers will ask for client's to be responsible for costs regardless of the outcome.

Whether the adjuster is calling from an office in Springfield, Joplin, Columbia, Kansas City, St. Louis or even out-of-state, adjusters are working for the insurance companies. The insurance companies employ highly trained adjusters who are paid to minimize your claim. That's why you need an experienced personal injury lawyer to help you in your Missouri Car Accident.

5_law_and_order.jpg

This is how it would work if a case settled for $50,000 with the attorney earning a 1/3 fee and incurring $300 in costs. The attorney would take $16,888 for his fee and get reimbursed the $300 with the rest going to the client. Of course, if the attorney were to fail to get any recovery for the client the lawyer would get no fee.

Read the agreement the attorney is asking be signed. Make sure to ask lots of questions before you consider signing the agreement and hiring your lawyer.

Aged Tires: Lawsuits Needed To Stop Corporate Wrongfull Acts

Corpoartions make decisions based on what will result in the most money going into their pocket--BELIEVE IT! Corporations do not make decisions based on what is safest for you or your family--BELIEVE IT! Therefore, in order to make corpoartations make decisions based on what is safest for your family and what is best for the corporate bottom line, the threat of lawsuits must be present.

The U.S. tire industry is selling tires that are old and dangerous. Too many people are losing their lives based on the decision to sell old tires.

Attorney David A. Payne will handle your defective product claim on a contingency fee basis.

Due to the complexities of product cases, this is a particular area where I will often seek advice from my colleagues in the evaluation of your case. In the appropriate case, I will associate with other attorneys so as to maximize your representation.

Big Truck Kills 5-Year Old Boy In Rear-End Crash ~ Tractor-Trialer Wreck In Jasper County Leaves One Dead And Several Injured

A sad and tragic story. The death of an innocent child is the hardest to take. A 5-year old Carthage child, Enoc N. Castanon, died Monday afternoon in crash involving the car he was riding in and a tractor-trailer on a Jasper County highway as reported by the Missouri Highway Patrol. The vehicle in which Castonon was a passenger slowed to make a left turn when the 18-wheeler driven by Betty J. Ray began to pass Castonon's car and as the car turned the truck struck the car.

David Payne is a Southwest Missouri Injury Lawyer who fights for the families of injured victims from Truck Accidents.

This is the story from the Springfield News-Leader about the wrongful death.

There were five other people who suffered injuries in the late afternoon crash on Mo. 96 and Route BB five miles east of Carthage and they were Silvia G. Castanon, 37, who suffered minor injuries; Adelfi Castanon, 3, minor injuries; Edwin J. Vasquez, 12, minor injuries; Keila R. Vasquez, Vasquez, 7, minor injuries; and Leslie N. Vasquez, 9.

All injured victims were taken to McCune Brooks Hospital in Carthage for treatment.

The accident occurred when a southbound 1996 Pontiac driven by Silvia G. Castanon was being followed by a 2007 Freightliner rig driven by Betty J. Ray, 59, of Neosho, the patrol reported.

18-wheelers and large commercial trucks are extremely dangerous
and injuries from their wreck often severe. The Missouri Highway Patrol reports hundreds of people are killed on Missouri roads every year as a result of negligent driving of commercial trucks.

NOTE: Accidents involving 18-wheelers and commercial trucks are given special attention by insurance adjusters and attorneys for the driver's company because of the high risk they know they are exposed to. The insurance companies and their lawyers want to limit their financial exposure.

I have experience with helping families after these types of wrecks and believe it imperative that an attorney be hired as soon as possible to represent the folks who are injured as a result of the negligence of commercial drivers. 16317459.jpg

I will work for you in seeing that the negligent driver and the trucking company is held accountable for the devastating effects that your injury or loss has caused.

If you or a family member has been injured by a negligent commercial driver, please contact a personal injury attorney with experience and have your legal rights and options explained to you. Call me today and I will give you a clear explanation of what I can do for you.

Death Results From Two-Car Crash in Texas County, Missouri ~ Possible Wrongful Death

A Houston, Missouri man was killed Wednesday in a Texas County crash according to the report from the Missouri Highway Patrol. Any experienced personal injury attorney would be willing to talk with the family members of the deceased to see if there is a possible financial recovery. There are going to be many auto insurance issues stemming from a wreck like this one. Where negligence and insurance exists there is typically money to recover.

The Springfield News-Leader story is available as is the Missouri Highway Patrol Accident Report.

Reportedly, the wreck occurred on Missouri 17, two miles south of Success, when the 2006 Ford driven by Ennis Lee, 42, of Houston crossed the center line and struck the 1999 Chevrolet driven by Sarah James, 26, of Mountain View nearly head-on.

Tragically, Lee was killed in the crash and was reportedly not wearing his seat belt, according to the patrol.

The other driver, James, suffered what the Patrol classified as moderate injuries and was taken to nearby Texas County Memorial Hospital in Houston and she was reportedly wearing a seat belt.

Missouri allows family members to recover money from an individual, insurance company or corporation that is legally liable for a loved one's death. Missouri law specifically states what damages are recoverable as a result of a wrongful death and an experienced personal injury lawyer know the value of a wrongful death claim can range greatly depending on the specific facts of a particular case. 18391037.jpg

With that said, Missouri courts and juries have a strong history of placing a high value on human life.

To best position your family following a wrongful death, you will need more than the compassion of the party at fault and more that the compassion of the insurance adjuster handling the claim. You will need the experience, knowledge and passion of an experienced personal injury attorney with the resources available to maximize your recover and compensation.

Barry County Car Accident Leaves Several Injured

A two-car accident on June 15, 2008 at about 4:30 p.m. in Barry County on Route Z at Pleasant Ridge resulted in serious injuries to one passenger and minor injuries to four others. Jonathan Gemmecke, 28, of Wheaton was seriously injured in the accident and was taken to St. Johns Hospital of Joplin. This an accident in which an experienced personal injury lawyer can help the victims.

Gemmecke was the driver of 1993 Toyota that crossed the center line and struck the vehicle driven by Matthew Karr a 2007 Dodge truck, according to the accident report of the Missouri Highway Patrol. Gemmecke's vehicle then overturned in the ditch and resulted in Gemmecke being ejected.

Karr and his three occupants, his wife and two children, were take to Cox Monett Hospital--all with what was described as minor injuries.

For those injured in a car accident it is imperative to immediately contact an attorney with experience in personal injury so as to preserve valuable legal rights and receive the valuable advice needed to have peace of mind while recovering from the accident.

Those injured will need legal guidance regarding how to obtain proper and necessary medical treatment and an experienced personal injury attorney in Barry County can help. Generally, good advice is to seek out advice from your family doctor and follow through with their recommendations. Following the advice of medical professionals is necessary to insure your health's recovery and any eventual financial recovery.

16717926.jpg
Experienced accident lawyers report one of the most common mistakes is that injured people will not get the medical care they need. The result this type of decision can have is a devastating effect on your health and your financial recovery.

If you cannot afford medical treatment, a lawyer may be able to assist you in finding medical care providers that will treat your injuries based upon a lien the provider would have on your eventual financial recovery from the insurance company. Such an agreement will help guarantee you get the full medical attention you deserve and avoid bills from piling up and going into collection status

Wrongful Death Lawsuit Will Follow Tragic Car Accident Involving Missouri Teens

Jarub Baird has been found guilty of second-degree involuntary manslaughter and second-degree assault as a result of the auto accident that killed a young Missouri teen according to a Joplin Globe report. Another chapter in the death of a Missouri teen has come to a close with the conviction of the person who drove the vehicle in which she lost her life Dec. 8, 2006. There is a wrongful death trial pending in Jasper County Circuit Court against Baird filed by Smallwood’s parents – Andrew and Deborah Smallwood.

If you or a family member has been injured in a car accident and would like to speak with an experienced personal injury attorney, call David Payne or contact him online.

In Missouri, as with most states, family members are able to recover money from an individual, insurance company or corporation that is legally liable for a loved one's death. The Missouri law, which is a statutory creature, specifically states what damages are recoverable in a wrongful death lawsuit. The value of a wrongful death lawsuit can and often does vary greatly depending on the specific facts of each particular case. However, Missouri courts and juries have a history of placing a very high value on human life.

A Stone County jury found 18-year-old Baird of Carthage guilty of second-degree involuntary manslaughter and second-degree assault as a result of the accident that killed Smallwood and injured two other Carthage teenage girls.

Also injured was passenger Calee Houlihan, who was sitting in the front seat of the vehicle, and fortunately she suffered only minor injuries. The car left the road, sheared a utility pole off at its base, slammed through a barbed-wire fence line and rolled about 100 yards before coming to rest on its side in a snow-covered field.13854798.jpg

Three of the four teenagers in the Mazda Millenia, including Baird, who was 17, were not wearing seat belts and were thrown from the vehicle. Smallwood, who was sitting in the back seat with Johnson, then 16, was thrown through the car’s windshield and died at the scene.

Johnson suffered a brain injury, a broken femur among other injuries. Baird walked away with only minor injuries. Houlihan, who was sitting in the front passenger seat and had put on her seat belt only moments before the crash, also suffered only minor injuries.

The state's attorney claimed that Baird was driving at an excessive rate of speed – at least 100 miles per hour – when he left the roadway. According to testimony, the car's other occupants had seen the speedometer read 110 mph before the accident.

According to the trial testimony of Missouri State Highway patrol accident reconstruction expert Lt. Albert Brown the vehicle was traveling at least 99 mph. However, Baird’s attorneys said Baird had volunteered to drive because the others had been drinking and Baird offered to be the designated driver.

As a result of the jury's conviction, Judge Gayle Crane of Jasper County Circuit court ordered a pre-sentence investigation and designated Aug. 14 as the date for sentencing.

Serious Injury Follows Barry County Car Wreck Near Roaring River State Park

Mary Mobbs,63, of Rogers, Arkansas was seriously injured and taken to Cox South Hospital in Springfield after the car she was driving struck a vehicle driven by Steven Smith, 49, also of Rogers, Arkansas.

Between the two vehicles there are four people injured and two different insurance companies that may be on the hook for financial losses of the injured. By speaking with a personal injury attorney as soon as possible following this type of wreck, an experienced injury attorney can best position his clients for prompt, fair and just settlement.

The above case will likely deal with issues of Missouri and Arkansas law. While the wreck happened in Missouri, some insurance issues will have Arkansas law molding the outcome of those particular issues. Cardin & Payne law firm works in both Missouri and Arkansas.Lonesome%20Road.jpg

This wreck occurred in Barry County on Missouri Highway 112 about 3 miles west of Roaring River State Park when Mobb's 1999 Hyundai struck the 2000 Toyota driven by Smith.

Smith's vehicle had two passengers that were also injured: Beth Smith and Nancy Ward.

In most all auto wreck cases, there is one or more insurance companies responsible for paying money for the injuries that follow. In my experience, insurance companies will too often come up with excuse after excuse in an attempt not to pay you what is owed.

An experienced insurance attorney will fight the insurance company for you! A bad faith insurance claim can arise when the insurance company puts its own interest ahead of its insured. If your insurance company has failed to pay you, there may be a claim against your insurance company.

Please give me a call for a free no-obligation and no-cost phone consultation or to schedule an office conference with me.

Here are some recommended tips on how to personally improve saftey for all on Missouri roads:

1. All drivers don't "recognize" a motorcycle properly; they ignore it even if usually unintentionally. Always look for motorcycles, especially when at an intersection.

2. A motorcycle may look farther away than you might think it really is. And estimated the speed of a motorcyle can be tough. Alwys predict a motorcycle is closer than it looks.

3. Motorcycles can be easily hidden in a car’s blind spots or masked by objects or backgrounds outside a car (bushes, fences, bridges, etc). Take an extra moment to thoroughly check traffic.

4. Because of its small size a motorcycle may seem to be moving faster than it really is. Don't assume all motorcyclists are speed demons.

5. Motorcyclists often slow by downshifting or merely rolling off the throttle, thus not activating the brake light. Allow more following distance, say 3 or 4 seconds. At intersections, predict a motorcyclist may slow down without visual warning.

6. Turn signals on a motorcycle usually are not self-canceling, thus some riders, (especially beginners) sometimes forget to turn them off after a turn or lane change. Make sure a motorcycle's signal is for real.

7. Motorcyclists often adjust position within a lane to be seen more easily and to minimize the effects of road debris, passing vehicles, and wind. Understand that motorcyclists adjust lane position for a purpose, not to be reckless or show off or to allow you to share the lane with them.

8. Maneuverability is one of a motorcycle's better characteristics, especially at slower speeds and with good road conditions, but don't expect a motorcyclist to always be able to dodge out of the way.

9. Stopping distance for motorcycles is nearly the same as for cars, but slippery pavement makes stopping quickly difficult. Allow more following distance behind a motorcycle because it can't always stop "on a dime."

10. When a motorcycle is in motion, don't think of it as motorcycle; think of it as a person.
