        <![CDATA[<p>Below is an interesting read about the "Love of the Law" as manifested by one particular third year law student.  I can't quite say that I possessed the same moxy while in the last semester of law school in Columbia. </p>

<p><em><strong><br />
WASHINGTON — Mike Sacks likes to be the first person in line for big Supreme Court arguments, and he was feeling pretty confident when he arrived at the court Monday morning around 8, 26 hours before the court would hear a big gun-control case. </p>

<p>But he found a couple from California already set up in lawn chairs. Robert Cumberland and Larken Euliss, two chemists from California, had arrived before dawn. </p>

<p>“I felt bad for him,” Mr. Cumberland said of Mr. Sacks. “But I’m not going to abdicate. I flew across the country for this.” </p>

<p>Mr. Cumberland wore a button that said “Guns Save Lives,” and he said the case to be argued on Tuesday, McDonald v. Chicago, was “going to force states like California to recognize that the Second Amendment is an individual right.” </p>

<p>Ms. Euliss had heard Mr. Cumberland’s analysis before. “I just think it’s neat that citizens can sit here and see law being made,” she said. </p>

<p>Mr. Sacks, a third-year law student at Georgetown, had set himself a goal, now shattered: he wanted to be the first person in line for every major argument this term. He brought three advantages to the task. He has no morning classes this semester, he lives pretty close to the court, and he has an unhealthy obsession with it. The name of his blog is a play on his habit of showing up early at the court’s street address: First One @ One First. </p>

<p>By Monday evening, the line had grown to about 30 people. There were gun-rights enthusiasts, along with Supreme Court groupies and law students. </p>

<p>Three men sat quietly in the winter gloaming. They were being been paid to hold places for others. One said he found the assignment on Craigslist, arrived at noon and would get $250 for 19 hours of work. He said his name was Benny and that he did not know his client’s name or profession. </p>

<p>About 15 enthusiastic and energetic students from Monta Vista High School in Cupertino, Calif., arrived not long after 7 p.m. It was like a camping trip, except with concrete and civics. An informal poll suggested that the students were leaning in favor of upholding the Chicago gun control law, one of the strictest in the nation, that is at issue in the case. </p>

<p>Three law students, two from Georgetown and one from George Washington, spoke earnestly about which part of the Fourteenth Amendment the court should use to apply the Second Amendment to state and local governments. </p>

<p>Josh Blackman was walking around telling people about his blog, which allows people to make predictions about how the term’s cases will come out. “I’m the czar of Fantasy Scotus,” he said by way of introduction, adding that he had recently barred three people from his site for cheating. </p>

<p>There were mixed feelings about whether making people wait all night in the cold to see their government at work was a reason to allow television coverage of Supreme Court arguments. Lyle Wincentsen said he was against cameras. “It turns it into a circus,” he said. </p>

<p>Corey Carpenter, a 23-year-old law student at George Mason University, was asked about his interesting blue hair. “It’s a personal commitment to liberty,” he explained. His decision to wait in line was impromptu, he said, and things were getting cold. His girlfriend would be bringing him some warm things, he said hopefully. </p>

<p>A large stack of pizzas arrived around 8 p.m., courtesy of the A.B.A. Journal, a legal magazine whose blog sometimes posts Mr. Sacks’s commentaries. The high school students hovered until Mr. Sacks invited them to dig in. </p>

<p>Around 6 in the morning on Tuesday, five burly men joined the group of placeholders, cutting the line. There was grumbling but nothing more. </p>

<p>Mr. Cumberland did not sleep all night, and by dawn on Tuesday, he was growing worried. “I don’t want to fall asleep during the argument,” he said. </p>

<p>As the sky brightened over the Capitol, the high school students were reading legal briefs and “The Nine,” a book about the Supreme Court. </p>

<p>Just after 7 a.m., the court police moved the line from the sidewalk to the steps in front of the court. Mr. Cumberland was told to take off his button. “No political logos on the plaza,” an officer said. A reporter asked the officer to explain the reasoning behind that rule. “You can’t interview people on the plaza,” the officer responded. </p>

<p>At 7:15, numbered placeholder’s cards were handed to the first 75 people in line. Chad Klinkenborg, who had arrived at 5:30 a.m., was No. 76. “I wish I’d gotten here a few minutes earlier,” he said. There were at least 30 people behind him. </p>

<p>The cards are not guarantees, and the number of seats set aside for members of the public who want to see entire arguments can be as few as 50. (There is a separate line for those interested in getting a three-minute glimpse.) </p>

<p>Mr. Cumberland looked punch drunk as he was given his card. “I hardly know what this case is about any more,” he said. “I’m so tired.” </strong></em></p>]]>

        <![CDATA[<p>Unbelievably frighting!  <a href="http://www.mo-injurylaw.com/"><em><strong>Anyone possibly involved will need to seek help fast.</strong></em></a></p>

<p><a href="http://www.mo-injurylaw.com/lawyer-attorney-1278580.html">Cox Hospital in Springfield </a>announced <u>half</u> of the patients who received a specific cancer treatment in the <u>last five years </u>from CoxHealth were <strong>exposed to dangerous levels of radiation</strong>.  Cox is performing its own internal review to see if this gross mishap resulted in any deaths.</p>

<p><u><strong>Here's some of the data reported so far: </strong> </u></p>

<p>-Of the 152 patients who received treatment from a specific piece of technology, <strong>76 were given between 20 to 70 percent more than their prescribed dose</strong>;<br />
-The others received what is considered safe or "therapeutic" levels of radiation -- which could be as much as 10 percent more than what was prescribed.<br />
-Of the entire group of patients treated with the improperly programmed BrainLAB attachment, <strong>90 died, which is 59%</strong>;<br />
-In the group that received<strong> more than 10% too much radiation, 48 patients -- or 63 % -- died</strong>.</p>

<p><em>"It is totally unacceptable to us that an error like this ever occurred,"</em> said John Duff, senior vice president of hospital operations for CoxHealth. <em>"We intend that no such error will occur ever again in the future."</em>  I also hope that Dr. Duff is willing to step up and see that any one effected by this will be legally compensated.</p>

<p>At a press conference, officials were asked if the rate of death in the overly radiated group was higher than what might be expected.</p>

<p>"In many cases, the tumors that these patients had were very serious, and many of these patients had a poor prognosis when they began their treatments," Duff said. "A review of patient records is ongoing and not yet complete, so it would be premature to say the overexposure had any impact on the current medical condition or, of those patients who are deceased, if it was a contributing factor in those deaths."</p>

<p>The error was the result of a physicist -- a board-certified technician -- using the wrong tool to <br />
calibrate the BrainLAB attachment on the radiationmachine. The error went undetected for five years, when in September 2009 a newly hired second physicist questioned the calibrating tools used by the chief physicist. All BrainLAB treatments were suspended at that time.</p>

<p>An internal and subsequent outside audit confirmed that the machine was calibrated correctly for all target areas except for those 1.1 centimeters or smaller. The hospital resumed the treatment for larger tumors in November.</p>

<p><br />
After further data showed that the variances in the radiation levels were off by high percentages, the entire program was suspended in January 2010. Duff said the program will remain suspended indefinitely.</p>

<p>CoxHealth received the final results after an analysis of all 152 patients' radiation levels Feb. 16. Duff said the hospital has been contacting patients since then.</p>

<p>The physicist who calibrated the machine no longer works at CoxHealth, but Duff declined to say whether the individual was fired or left voluntarily. He said hospital policy has changed to ensure more safeguards and more trained staff monitoring radiation technology.</p>]]>

<p><a href="http://www.mo-injurylaw.com/lawyer-attorney-1278580.html">Toyato and other auto manufacturers are ultimately legally responsible</</a> <em>if</em> their products are unsafe. Thousands of people continue to be <a href="http://www.mo-injurylaw.com/lawyer-attorney-1278582.html">harmed every year as a result of corporations making decisions</a> based upon what goes in their pocket and not the ultimate safety of the citizens using their products.  Well, money is the root of all evil, right?</p>

<p>In an internal presentation last year, Toyota officials claimed they saved over $100 million by delaying safety regulations, avoiding defect investigations and slowing down other industry requirements.  Not to shabby, well, deplorable reall.  The story is--Toyota saved $100 million by successfully negotiating with the government on a limited recall of floor mats in some Toyota and Lexus vehicles, according to new documents shared with congressional investigators.</p>

<p>The documents could set off alarms in Congress, and with Plaintiffs' lawyers, over whether Toyota put profits ahead of customer safety and pushed regulators to narrow the scope of recalls. The answer is most certainly: YES.  </p>

<p>The world's largest automaker has been widely criticized for responding painfully too slow to complaints of sudden acceleration in its vehicles.</p>

<p>Toyota said in a statement, and you tell me if this is honest, or an honest attempt at spin: <em>"Our first priority is the safety of our customers and to conclude otherwise on the basis of one internal presentation is wrong. <p>A Russian student visiting Branson in the Summer 2008 suffered a <strong>severe head injury </strong>in a fall off a motel balcony and recently reached a <a href="http://www.mo-injurylaw.com/index.html"><strong>$2 million settlement of his Christian County premises liability</strong> </a>case against the motel. <a href="http://molawyersmedia.com/blog/2009/04/02/russian-student-settles-suit-for-2-million/" target= “_blank” >Missouri Lawyers Weekly </a>reported Jill Frost, Kansas City attorney for Bahy, confirmed the settlement details but declined further comment.</p>

<p>While working in Branson during the summer of 2008, Naumenko and several other Russian friends had gathered at the Queen Anne II Motel on Aug. 30, 2008, to celebrate the end of the summer.  Naumenko was leaning against the outside walkway railing on the second floor of the motel and without warning the railing collapsed, causing Naumenko to fall about 20 feet to the parking lot below.</p>

<p>Naumenko suffered a <strong>serious head injury (traumatic head injury)</strong> and was life-flighted to St. John’s Hospital, Springfield. After <strong>more than 100 days in the hospital </strong>and <strong>multiple surgeries</strong> — including placement of intracranial pressure monitors, an emergent bifrontal decompressive craniectomy and a bifrontal cranial defect reconstruction — <strong>Naumenko was able to return to Russia about four months after the fall</strong>.</p>

<p><u>Police photographs of the railing taken the night of the fall showed it was <strong>not bolted </strong>to the adjacent support posts.</u></p>

<p>Plaintiff’s counsel also learned there was a foreclosure action on the motel pending in Taney County between defendants Berag Singh Bahy and Queen Anne Hospitality Corp. The Taney County court file contained a copy of the purchase agreement between the two defendants entered in 2006.  <em>Oh, how rich this purchase agreement was for the plaintiff's case on linking liability to both Bahy and Queen Anne.</em></p>

<p>The plaintiff asserted that an addendum to the purchase agreement showed both defendants had known the railing was unsecured and <strong>unsafe for almost two years </strong>before Naumenko’s fall, but neither defendant had ever fixed it. <strong>"It appears the defendants had been fighting over who should fix the railing and do other needed repairs.  Neither defendants' pride seemingly would allow them to fix this railing...it would have taken a few minutes and a $2 bolt!"</strong>After identifying the defendants’ insurance information during initial discovery, plaintiff issued a policy limit demand, left open for 30 days. The defendants didn't let the 30 days pass before tending policy limits.  The parties settled for the defendants’ combined policy limits of $2 million.</p>]]>

    <title>MO Rear-End Collision Leaves Illionois Man with Severe Injuries</title>

        <![CDATA[<p>According to the Missouri State Highway Patrol, William H. Pridemore, 51, of Quincy, Illinois was taken to the hospital after he was hit from behind by a 2007 Mack dump truck on the morning of December 28, 2009. </p>

<p>This <a href="http://www.mo-injurylaw.com/lawyer-attorney-1278523.html"><strong>commercial trucking accident</strong></a> transpired on Missouri Highway 6, about two miles east of Kirksville, when the 2003 Freightliner van, driven by Pridemore, was stopped and attempting to turn left when he was struck in the rear by the Mack truck, driven by Edwin E. West, 48, of Kirksville. The van then traveled off the right side of the roadway and came to a rest. Pridemore was then transported by ambulance to Northeast Regional Medical Center with <a href="http://www.mo-injurylaw.com/lawyer-attorney-1278484.html"><strong>serious personal injuries</strong>.</a></p>

<p><strong>•	In 2007, there were a total of 72,155 crashes that involved passenger cars in Missouri.<br />
•	The percentage of these crashes that resulted in fatalities was about 0.06 percent.<br />
•	In 2007, there were a total of 5,052 crashes that involved 18-wheeler and large trucks.<br />
•	The percentage of these crashes that resulted in fatalities was about 2.0 percent.</strong></p>

<p>As you can see from the statistics above, <u>18-wheeler and large truck accidents are nearly four times more likely to result in fatalities than accidents involving passenger cars</u>. These accidents can often be life changing for the persons involved and their families. </p>

<p>Based on the Missouri State Highway Patrol’s accident report, it appears that the driver of the dump truck failed to slow down or didn’t see Pridemore as he was attempting to turn. If that was the case, both the truck driver and his employer could be held liable for the accident and the injuries that resulted from the crash.</p>

<p>This particular accident could have happened because the truck driver was careless and didn’t slow down. The 18-wheeler truck’s brakes could have failed. Or the truck driver could have been distracted. All of these are the most common causes of large truck accidents in the United States.</p>

The van then ran off the right side of the roadway and overturned. Rodgers, Jamie L. Jaegers, 30, of Troy, MO and Michelle R. Lee, 38, of Fulton, MO were ejected from the vehicle.</p>

<p>Rodgers, Jaegers, Martha J. Krampe, 39, of Williamsburg, MO, Cynthia A. Hopkins, 51, of Columbia, MO and Martha A. Gardner, 64, of Jefferson City, MO, all of the van, were transported to the University of Missouri Hospital in Columbia with serious injuries. Lee was pronounced dead at the hospital later that evening.</p>

<p>Wilson was transported to Audrain Medical Center with minor injuries.</p>

        <![CDATA[<p>The U.S. Consumer Product Safety Commission (CPSC), along with Stork Craft Manufacturing Company, of British Columbia, Canada, announced on November 23, 2009, the recall of more than 2.1 million <a href="http://www.mo-injurylaw.com/lawyer-attorney-1278582.html"><strong>defective Stork Craft drop-side cribs </strong></a>with a plastic trigger and one-hand-system drop-side hardware.</p>

<p>This recall also included about 147,000 Stork Craft drop-side cribs with the Fisher-Price logo. These recalled children’s products were manufactured between January of 1993 and October of 2009.</p>

<p>Yasmin is a birth control pill that was brought to the market in 2001 by Bayer Healthcare. A second contraceptive, Yaz, hit the hands of consumers in 2006. The generic brand of these pills is Ocella, which is manufactured by Barr Laboratories Inc. They are combination oral contraceptives COCs, meaning that they contain an estrogenic and progestational component that work together to suppress ovulation, fertilization and implantation and thus prevent pregnancy.</p>

<p>Birth control pills have been linked to a higher risk of blood clots, heart attacks and strokes since their introduction in the 1960s. Since then, pharmaceutical companies have continually developed newer versions of COCs to lower these associated risks. Yet, in this process, Bayer and Barr have produced an oral contraceptive that contains a new progestin, drospirenone, <strong>which is just as dangerous.</strong></p>

<p>Studies done before the FDA approval of Yaz, Yasmin and Ocella indicate that drospirenone has certain effects that are different than those of traditional progestins and <a href="http://www.mo-injurylaw.com/lawyer-attorney-1284651.html">potentially more dangerous</a>. Specifically, drospirenone raises potassium levels in the blood, which can lead to hyperkalemia. This condition causes heart rhythm disturbances like extrasystolies, pauses and bradycardia. Hyperkalemia disrupts the normal rhythm of the heart and the flow of blood through the heart can be slowed to the point of forming blood clots. <strong>Blood clots can lead to heart attacks and strokes.</strong></p>

<p>In addition, Yasmin and Yaz contain chemical properties similar to diuretics, which reduce water retention and bloating. However; excessive loss of body fluids can lead to dehydration. <strong>Severe dehydration can also increase the risk of blood clots and kidney disease</strong> by making blood thicker, which causes constriction and the narrowing of blood vessels. </p>
