Springfield Auto Accident & Injury

Two injured Missourians were taken to the hospital this morning after a three-car accident on Kearney Street and National Avenue in Springfield reports the Missouri Highway Patrol. This is the exact type of crash were the injury victims NEED to contact an attorney promptly in order to get the advice necessary for protecting their rights.

As you can tell from the facts, this one is a little tricky. The accident resulted when a 1996 Pontiac Grand Am driven by Travis Jones of Springfield failed to stop for a red light, then, Jones’ car struck a 2006 Ford Crown Victoria driven by Ivy Warren of Willard in the right rear of the car.Warren’s car was then forced into a 1996 Ford Taurus driven by John Albert of Springfield. Who is exactly at fault and how will the insurance policies apply? These are questions the injury victims will need help from an attorney with answering.

Albert suffered moderate injuries and was directly taken to St. John’s Hospital. Warren suffered minor injuries and was taken to St. John’s Hospital.

Vehicle accidents and wrecks on our Nation's roadways are an extremely serious threat to the traveling public and are the leading cause of death for people under the age of thirty-four. Every year over 40,000 people are killed in approximately five million motor vehicle accidents, many involving teens. In 2002 alone, nearly 43,000 people died in highway accidents nationwide. That equates to over 115 fatalities per day from something that could have avoided.

Unfortunately, during your lifetime you are likely to be involved in at least one auto accident. You MUST know what to do in order to protect yourself and your legal rights and it all begins with talking with an experienced auto accident attorney.

Call the police and paramedics if necessary. If you have a camera or even a cell phone with photo capabilities, photograph the scene prior to moving the vehicles (only if safe to do so). Additionally, someone should interview all witnesses and record their comments and descriptions and should be completed as soon as possible as witnesses' memories tend to fade with time.

Your attorney may hire a professional investigator and help determine insurance insurance company policies. While preparing your case, your attorney may find it helpful to hire other experts to assist in proving who was actually responsible for your injuries or the injuries of a loved one.

You Can't Afford NOT To Hire An Attorney: Simple Legal Advice For Missouri Residents

If you’ve been injured, arrested, or sued, you’re wondering if you should hire a lawyer and if so, how much it would cost. Should I hire the guy I see on TV? Or you might not even think to hire a lawyer because you just assume that it’s too expensive and that lawyer are just jerks and that you would be better off avoiding attorneys all together. Maybe you think you could probably get by on your own. A lot of people who DO hire lawyers have good experiences and know that their time and money was well invested.

GET A FREE CONSULTATION

Good news: many attorneys offer free consultations. So, other than a little bit of your time, there is no reason not to meet with a lawyer and find out how an experienced legal advisor and advocate could help you. Furthermore, most personal injury attorneys (including David Payne Law) work on what’s called a ‘contingency fee basis” meaning you won't have to have money to hire a lawyer. The lawyer will not charge you legal fees upfront, but will take his or her fees out of whatever settlement or award you receive. If you don't recover from the case, then the attorney doesn’t get a fee either. 17057308.jpg
Although, ask the attorney if you will be responsible for the cost if you lose. Most injury cases taken by David Payne Law on a contingency don't allow the attorney to charge ANYTHING from the client if there is no recovery.

Another way to think about this… what would it cost you NOT to hire a lawyer? What consequences will you suffer by not having the needed legal advice or representation? While in some cases, you might be able to successfully resolve the matter yourself, but for cases in which anything valuable is at stake (your freedom, your health, your money, your pain and suffering), the consequences of not hiring a lawyer could be devastating. Do not take such an unnecessary risk!

If you’ve been in an accident, most times it is not in your best interest to talk to that nice insurance adjuster. Their job is to make you think the settlement they offer you is a “good deal”… but the insurance adjuster, no matter how nice they seem, is looking out for the insurance company’s best interest - not yours. Only an attorney would know what a “good deal” is under the law given your situation.

If you’ve suffered an injury, are involved in a lawsuit, or have any other legal matter pending, don’t jeopardize your rights and your family's well-being.

Contact an attorney and ask about an initial consultation. Only make the decision NOT to hire a lawyer after you know what a lawyer can do for you.

Wrongful Death Claims: Seek Justice for Your Family’s Loss

Under Missouri Law (Missouri Statute 537.080.1), a dependent family member may be eligible to recover money from the individual or corporation that is legally liable for a death of a loved one. Aggressive legal representation is a must. The law is very specific about who may sue for wrongful death damages. The person bringing the wrongful death claim must be the parent, surviving spouse or child. Or, in some instances, a wrongful death claim may be brought with no familial claim to damages; a plaintiff ad litem may be appointed by the court to proceed if no other person is suitable.

MADD Hold Candlelight Vigil In Memory Of Accident Victims

As an injury attorney, the most heart-wrenching stories I come accross involve tragedies that are completely avoidable. Tragedies that were caused by the selfish, mindless acts of others don't simply bohter me, they appaul and outrage me.

However, out of these preventable tragedies often comes great compassion. When a community sets out to right a wrong, when a community supports the victims, when a community endeavours to stop the senselessness of drunk driving--a greater good can be accomplished.

My thoughts and prayers go out to the family and the community discussed in the St. Louis Post-Dispatch story which I have listed below. God Bless.

ST. LOUIS POST-DISPATCH
12/07/2008

Kirkwood — Six-year-old Luke Schaff doesn't remember much about his uncle.

It's been more than two years since Zachary Huggins, 22, of Harvester, was killed in a drunk driving accident, and his nephew, Luke, was only 4 at the time. Huggins was a passenger in a car driven by a drunken driver who swerved off the road and struck a utility pole.

That's why Pam Huggins, Luke's grandmother and Zachary's mother, said she liked her grandchildren to attend events such as the candlelight vigil Saturday sponsored by Mothers Against Drunk Driving Gateway Affiliate. Zachary is absent from their lives on a daily basis, but she doesn't want the children to forget about their uncle.

"That's the one way we try to get them to remember," she said.
Dozens of families of people killed in drunk driving accidents gathered at the Kirkwood United Methodist Church on Saturday to honor the memories of their lost loved ones and bring attention to the dangers of driving under the influence.

For Pam Huggins, her message is simple.

"It's so preventable. It's so needless," she said. "Our children were stolen from us and they didn't have to be."

Brian Buchholz, of St. Louis, said he started attending MADD meetings after his stepdaughter, Nicole Allen, 21, died in a drunk driving accident last year.

Allen, a junior at the University of Missouri-St. Louis, was a passenger in a car that was stopped at a red light when another car plowed into it, killing Allen and injuring two others. The driver of the other car had a blood-alcohol level of 0.24 percent when the crash occurred, police reported at the time — three times the legal limit.

Buchholz said that the experience had been extremely trying for his family, but that coming to events such as the candlelight vigil helped.

"You need a place to go to be sad," he said. "You need to be around people who have been through what you've been through."

Now, Buchholz said, he is honing his public speaking skills in hopes of eventually giving presentations to groups of people. He wants to tell his family's story because, he said, it's one that is repeated far too often.

"This was always something that happened to other people," he said.
